1. Acceptance of Terms

By accessing or using Swively ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Description of Service

Swively is a marketplace that connects independent wellness and beauty professionals ("Professionals") with space hosts ("Hosts") who rent treatment rooms and studios, and with clients who book appointments with Professionals.

3. User Accounts

You must create an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must be at least 18 years old to create an account.

4. Payments and Fees

Swively facilitates payments between clients, professionals, and hosts via Stripe. Swively charges a platform fee on completed transactions. All fees are disclosed at the time of booking. Refunds are subject to the cancellation policy set by each Professional or Host.

5. Cancellation Policy

Cancellation policies are set by individual Professionals and Hosts. Swively is not responsible for refunds outside of the stated policy. In cases of dispute, Swively may mediate but has final discretion.

6. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose
  • Harass, abuse, or harm other users
  • Post false, misleading, or fraudulent listings
  • Circumvent the Platform to avoid fees
  • Scrape, copy, or redistribute Platform data without authorization

7. Intellectual Property

Swively and its content are protected by copyright and intellectual property laws. You retain ownership of content you post but grant Swively a license to display it.

8. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind. Swively does not guarantee the quality, safety, or legality of services offered by Professionals or Hosts.

9. Limitation of Liability

To the fullest extent permitted by law, Swively shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

10. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
